SRINAGAR — Jammu and Kashmir High Court on Monday issued a notice to the state government on a plea seeking striking down of the ban on movement of civilian vehicles on the Jammu-Srinagar national highway on Sunday and Wednesday.
The court issued the notice after a plea filed by bureaucrat turned politician Shah Faesal.
“We are going to challenge this order in the Hon’ble High Court of J&K. This illogical order banning movement of civilians on National Highway for two days a week is totally against the spirit of Article 19 and Article 21 of the Constitution,” Shah Faesal had tweeted.
A division bench of Chief Justice Gita Mittal and Justice Tashi Rabstan issued a notice to the state government on Monday through Shah Faesal’s Counsel advocate Tassaduq Khwaja.
The division bench directed that the petition be listed for next hearing on Tuesday.
Faesal, in his PIL, has sought quashing of the order passed by the state government last week, according to which the movement of civilian traffic on National Highway 44 between Udhampur and Baramulla has been banned on Sunday and Wednesday to allow safe passage to government forces’ convoys.
